You may be wondering:
Chapter 7 BankruptcyChapter 7 bankruptcy will give you a fresh start. It will provide relief from creditors, stop foreclosure, eliminate unsecured debt and help you get control of your financial position. Chapter 7 is the simplest and quickest form of bankruptcy, but it is important to have an attorney guide people through that process. Chapter 7 Bankruptcy Process1) A "means test" determines whether a client is eligible to file for Chapter 7 bankruptcy. This test is used to limit Chapter 7 to those people who truly can't repay their debts. If a person's income is below the median income for families in Colorado, then they will be eligible for Chapter 7. 2) Prepare the bankruptcy petition called Statement of Financial Affairs. This statement contains extensive schedules requiring a detailed list of a person's debts. 3) The court issues a notice to creditors that places an "automatic stay" on a person's property and gives them a break from litigation. 4) After bankruptcy is filed, the client must appear at the meeting of creditors, also called a "341" meeting. The trustee can ask questions about a client's property and debts. Creditors can ask questions as well. Creditors have 60 days after this meeting to convince the bankruptcy court that the client should not be allowed to drop their debts. Many times, creditors do not receive the full amount owed by the client. In some cases, creditors receive no payment at all, or clients can keep all of their property. As your attorney, Mr. Solot will ensure that you understand the bankruptcy process and the consequences of filing. He knows that every client has a unique case, and he will give you the information you need to make the best decision for your family and your financial future. He can also help you rebuild your credit after filing.
